1. Scope of This Policy
This Refunds Policy applies to all purchases of digital products (PDF publications, guides and downloadable content) sold through Inkypyrus partner pages and the Inkypyrus website.
Monthly publishing partnership subscriptions are governed separately by the Terms of Service, which sets out cancellation terms, billing cycles, and the conditions under which subscription fees are or are not refundable. In the event of any conflict between this policy and the Terms of Service for subscription matters, the Terms of Service prevails.
2. Definitions
- “We”, “Us” or “Our” refers to Inkypyrus, a sole proprietorship registered in South Africa.
- “You” refers to the individual or entity purchasing our Services or Products.
- “Services” includes publishing partnership services offered by Inkypyrus, including content production, distribution and related managed services.
- “Products” includes digital items — PDF publications, guides and downloadable content — sold through Inkypyrus partner pages or the Inkypyrus website.
- “Purchase” refers to any transaction for Services or Products through our website or other authorised channels.
3. Eligibility for Refunds
We strive to ensure satisfaction with every purchase. Refunds are available only under the following specific circumstances:
Refundable circumstances
- Non-delivery: A Product or Service was not delivered as promised due to an error on our part — for example, failure to provide a purchased digital publication within the agreed timeframe.
- Defective product: A Product is materially different from what was advertised, or is inaccessible due to a technical fault on our end, and the issue is reported within 7 days of purchase.
- Service failure: A Service was not performed to the standard explicitly promised in your service agreement, and you provide verifiable evidence of the discrepancy within 7 days of service completion.
- Statutory rights: The purchase qualifies for a refund under the South African Consumer Protection Act (CPA) 68 of 2008 — for example, within the 7-day cooling-off period for direct marketing transactions (Section 16, CPA), where applicable.
4. Non-Refundable Circumstances
Refunds will not be granted in the following cases:
- Change of mind or subjective dissatisfaction: Where you are dissatisfied due to unmet expectations, creative differences, or subjective preferences not explicitly guaranteed by us.
- Digital products accessed: Digital products — PDF publications, guides and downloadable content — are non-refundable once downloaded or accessed, in accordance with Section 42 of the Electronic Communications and Transactions Act (ECTA) 25 of 2002.
- Subscription services commenced: Monthly publishing partnership fees are non-refundable for work already commenced or delivered in the current billing period. See the Terms of Service for full cancellation terms.
- Speculative or market-based outcomes: We are not responsible for outcomes tied to market performance, reader reception, or other inherent uncertainties in content publishing.
- Promotional or final-sale purchases: Purchases made during promotions or marked as final sale are non-refundable.
- Misuse or non-compliance: Issues arising from your failure to follow provided instructions, misuse of products or services, or unauthorised modifications.
We reserve the right to decline refund requests that do not meet these criteria or that appear to be made in bad faith.
5. Refund Process
To request a refund, follow these steps:
- Submit a request: contact us via our contact page within 7 days of the purchase date or receipt of the product or service. Include your order details, a clear explanation of the issue, and any supporting evidence.
- Review period: We will review your request within 5 business days and notify you of our decision by email.
- Processing: If approved, refunds will be issued to the original payment method within 14–21 business days. Processing times may vary depending on your payment provider.
No additional fees will be charged for approved refunds. Original transaction costs such as bank or payment processing fees may be non-refundable depending on the provider.
6. Statutory Rights Under South African Law
This policy does not affect your statutory rights under the Consumer Protection Act (CPA) 68 of 2008. In particular:
- You may return products within 7 days for direct marketing transactions (Section 16, CPA).
- Products must be of satisfactory quality and fit for purpose (Section 55, CPA).
- Services must be performed with reasonable care and skill (Section 54, CPA).

7. Exceptions & Limitations
- Digital products: Once accessed or downloaded, digital products are non-refundable unless defective or materially different from what was described.
- Custom services: Services tailored to your specifications are non-refundable unless we fail to meet explicitly agreed terms.
- Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, technical failures, or third-party service disruptions.
- Policy updates: We may revise this policy at our discretion. Changes will be posted on inkypyrus.com with a revised effective date. Continued use of our services constitutes acceptance of the updated policy.
